Davis House secures summary judgment in products liability case
Anderson Crawley & Burke is proud to announce that Davis House secured summary judgment on behalf of our client, a construction materials supplier, in a complex product liability case marking the first successful use of the “component parts doctrine” in Mississippi outside of the pharmaceutical industry.
The plaintiff filed suit against several different entities alleging claims of negligence and violations of the Mississippi Products Liability Act after sustaining serious injuries stemming from a gas grill explosion at a local apartment complex. Thanks to Mr. House’s thorough advocacy, the court agreed that our client merely supplied component materials and played no role in designing or constructing the enclosure for the gas grill, which was the final product at issue in the case. All in all, the court ruled that no genuine issue of material fact existed as to whether our client was liable for any defect in the grill’s enclosure or any allegedly hazardous design of the enclosure itself, and dismissed the claims against it in full.
